Privacy Policy.

What Code With Power collects, how we use it, who we share it with (almost nobody), and your rights to access, correct, or delete your data.

1. Information We Collect.

Code With Power ("we", "us", "our") collects information when you interact with our website or services. The categories below describe what we collect and why.

Information you provide directly

  • Contact form submissions: name, email, phone (optional), business name, and any message content you submit.
  • Free audit requests: name, email, and the URL of the site you'd like audited.
  • Client engagement records: billing contact, project scope, and (for care-plan clients) admin credentials needed to maintain your site.
  • Email correspondence: messages you send us at [email protected] or other published addresses.

Information collected automatically

  • Standard server logs: IP address, user-agent, request URL, response code, and timestamp. Retained for security and operational diagnostics.
  • Analytics: aggregate, anonymized usage statistics if and where a privacy-respecting analytics tool is enabled. We do not deploy invasive cross-site tracking.
  • Cookies: see Section 4 below.

2. How We Use Your Information.

We use the information you provide and the information collected automatically to:

  • Respond to inquiries and deliver the services you request.
  • Send transactional communications (project updates, invoices, care-plan reports).
  • Maintain, secure, and improve our website and services.
  • Comply with legal obligations and protect against fraud or abuse.

We do not sell your personal information. We do not share your contact details with third-party marketers. We do not enroll you in unrelated marketing lists when you contact us about a project.

3. Sharing & Disclosure.

We share personal information only in the following limited circumstances:

  • Service providers acting on our behalf: hosting providers, email delivery services, payment processors, and infrastructure vendors who process information under contractual confidentiality and security obligations.
  • Legal requirements: when required to comply with a valid legal process, court order, or government request.
  • Business transfers: in the unlikely event of a merger, acquisition, or sale of substantially all of our assets, your information may transfer to the successor entity under the same protections described here.
  • With your consent: any other sharing requires your explicit consent.

4. Cookies & Tracking.

Our website may use cookies and similar technologies for the following purposes:

  • Strictly necessary cookies: session cookies for authentication and basic site operation. These cannot be disabled without breaking site functionality.
  • Functional cookies: remember preferences (e.g., navigation drawer state) to improve usability.
  • Analytics cookies: aggregate, anonymized usage data where enabled. No third-party advertising cookies are placed by Code With Power.

5. Data Security.

We implement reasonable technical and organizational measures to protect personal information against loss, misuse, unauthorized access, disclosure, alteration, and destruction. These include encrypted-in-transit connections (HTTPS), hardened hosting infrastructure, access controls on backend systems, and regular security audits. No method of transmission or storage is 100% secure; we cannot guarantee absolute security, and you transmit information at your own risk.

6. Your Rights & Geographic Scope.

Where we do business. Code With Power is a Memphis, Tennessee business. The majority of our clients are based in Tennessee; a smaller portion are located in other U.S. states. We do not currently market or contract with clients located outside the United States. We may consider international clients in the future; if that changes, this policy will be updated to reflect any cross-border data-handling commitments.

Tennessee residents (TIPA — Tennessee Information Protection Act)

Tennessee residents have the right to: confirm whether we process your personal information; access the personal information we hold about you; correct inaccurate personal information; delete personal information you have provided; obtain a copy of the personal information you have provided in a portable, machine-readable format; and opt out of any targeted advertising, sale of personal information, or profiling that produces legal or similarly significant effects. Code With Power does not sell personal information, conduct targeted advertising, or engage in automated profiling. To exercise any TIPA right, contact us at [email protected]; we will respond within 45 days as required by Tennessee law.

California residents (CCPA / CPRA)

California residents have the right to: know what personal information we collect about you; access and obtain a copy of that information; request correction of inaccurate information; request deletion of personal information (subject to legal exceptions); opt out of any sale or sharing of personal information (we do not sell personal information); and not be discriminated against for exercising these rights. Other U.S. states

Several U.S. states (including Virginia, Colorado, Connecticut, Utah, and others) have enacted comprehensive consumer-privacy laws granting rights similar to the Tennessee and California provisions described above. If you reside in one of these states and wish to exercise a state-law privacy right, contact us at [email protected] and we will respond in good faith and within the timeline required by your state's law.

6a. Protection of Your Information.

Protecting the information you share with Code With Power is a foundational commitment of how we run the shop. Concretely:

  • We do not sell your data. Not to advertisers, not to data brokers, not to anyone — ever.
  • We do not enroll you in marketing lists. Contacting us about a project does not subscribe you to anything. We will only email you about the work you've asked us to do.
  • We minimize what we collect. If a form field isn't needed to do the work or respond to your inquiry, we don't ask for it.
  • We secure what we store. HTTPS in transit, hardened hosting, access controls on backend systems, and regular security audits (per Section 5 above).
  • We delete on request. Tennessee, California, and other state-law deletion requests are honored within the timeline your state's law requires.

7. Children's Privacy.

Our website and services are not directed to children under 13 (or 16 in jurisdictions where that age threshold applies). We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected personal information from a child, we will delete that information promptly. 8. Changes to This Policy.

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or for other operational reasons. The "Last Updated" date at the top of this page indicates when the policy was most recently revised. Material changes will be communicated through reasonable channels (notice on the site or direct email to active clients) before they take effect.

10. Terms of Service.

By engaging Code With Power for a web design, development, or care-plan project, you agree to the following terms in addition to any signed proposal or statement of work between us.

Engagement & payment

  • Web design projects require a 50% deposit at kickoff; balance is due at launch (or split across milestones for Growth / Pro tier scopes). Care plans are billed monthly in advance.
  • Any work outside the scope of the signed proposal is quoted as a written change order before any out-of-scope work begins. No surprise invoices.
  • Care plan tier upgrades / downgrades take effect the following billing cycle. Care plans may be cancelled with 30 days written notice; no long-term contract is required.

Ownership & intellectual property

  • On final payment, all custom code, content, and design assets specifically created for your project transfer to you for use on the site we built. You own your site.
  • Third-party licensed components (premium plugins, fonts, stock imagery) remain subject to their respective licenses; we'll disclose any such components in the project scope.
  • Code With Power retains the right to display non-confidential project work in our public portfolio and case studies unless you request privacy in writing.

Hosting, uptime & care plans

  • Care plans cover the services described on the pricing page and your signed care-plan summary. They do not constitute a hosting SLA in the traditional enterprise sense; we monitor uptime and respond to incidents on a best-effort basis appropriate to each tier.
  • Backups are stored off-server. Restoration time depends on tier and incident severity.

Warranty & limitation of liability

  • We warrant that delivered work materially conforms to the agreed scope at the time of delivery. Beyond that, all services are provided "as is" without further warranty, express or implied.
  • To the maximum extent permitted by Tennessee law, Code With Power's total liability for any claim arising from our services is limited to the fees paid to us under the corresponding project or care plan in the twelve (12) months preceding the claim.
  • Neither party will be liable for indirect, incidental, special, consequential, or punitive damages.

Governing law & venue

These terms and any dispute arising from the relationship between you and Code With Power are governed by the laws of the State of Tennessee, without regard to its conflict-of-law principles. Exclusive jurisdiction and venue for any legal action lie in the state or federal courts located in Shelby County, Tennessee.

Modifications

We may update these Terms from time to time. Material changes will be communicated to active clients before they take effect. Continued use of our services after notice constitutes acceptance of the updated Terms.
